RaceWise.ai provides software tools for racing teams and related organizations to manage setup data, race logs, results, driver feedback, collaboration workflows, and analytics. We may add, modify, or remove features from time to time.

3. Accounts

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for activities that occur under your account, whether or not authorized by you, unless caused solely by our failure to maintain reasonable security.
  • You must promptly notify us of suspected unauthorized use or security incidents.

4. Acceptable Use

You agree not to misuse the Service. Without limitation, you must not:

  • Use the Service for unlawful, fraudulent, or harmful purposes.
  • Attempt to gain unauthorized access to accounts, systems, or data.
  • Interfere with or disrupt the integrity, performance, or availability of the Service.
  • Upload malicious code, malware, or content that infringes the rights of others.

5. User Data and Content

Users retain ownership of data and content they upload to the Service. By submitting content, you grant RaceWise.ai a limited, non-exclusive right to host, copy, process, transmit, and display that content solely as necessary to operate, secure, improve, and support the Service.

You represent that you have the rights and permissions necessary to upload and use your content in the Service.

6. Service Availability

We aim to provide a reliable Service, but we do not guarantee uninterrupted or error-free availability. Maintenance, updates, network issues, third-party failures, and other events may affect availability.

7. Fees and Billing

If the Service is offered on a paid basis, applicable fees, billing terms, and renewal conditions will be presented at the time of purchase or in a separate order form. Unless otherwise stated, fees are non-refundable except as required by law.

8. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis. RaceWise.ai disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and that the Service will be uninterrupted, accurate, or error-free.

9. Limitation of Liability

To the maximum extent permitted by law, RaceWise.ai and its affiliates, officers, employees, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, or business opportunities arising out of or related to the Service.

To the maximum extent permitted by law, RaceWise.ai's aggregate liability arising out of or relating to the Service will not exceed the amounts paid by you to RaceWise.ai for the Service during the twelve months preceding the event giving rise to the claim, or EUR 100 if no fees were paid.

10. Suspension and Termination

We may suspend or terminate access to the Service if we reasonably believe you have violated these Terms, created risk or legal exposure for RaceWise.ai, or if required by law. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

11. Intellectual Property

RaceWise.ai and its licensors own all rights, title, and interest in the Service, including software, design, branding, and related intellectual property, excluding user-provided content.

12. Governing Law

These Terms are governed by the laws of Estonia, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the competent courts of Estonia, unless applicable law requires otherwise.

13. Changes to Terms

We may update these Terms from time to time. Updated Terms will become effective when posted or on a later date specified in the update. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

6. Data Sharing

We do not sell personal data or racing data. We may disclose information only in limited circumstances.

  • To trusted subprocessors and service providers that support hosting, infrastructure, monitoring, analytics, communications, or support, subject to appropriate confidentiality and data protection obligations.

Data Processing Agreement

1. Purpose and Scope

This Data Processing Agreement ("DPA") applies where RaceWise.ai processes personal data on behalf of a customer or organization using the Service. In that context, the customer acts as the controller and RaceWise.ai acts as the processor, except where RaceWise.ai acts as an independent controller under applicable law.

2. Subject Matter and Duration

RaceWise.ai processes personal data for the duration of the applicable customer relationship, and only as necessary to provide, secure, support, and improve the Service in accordance with documented instructions from the customer, this DPA, and applicable law.

3. Nature and Purpose of Processing

  • Hosting, storage, organization, retrieval, transmission, and display of customer data.
  • Facilitating collaboration, logs, race operations, setup records, results, notes, and related workflows.
  • Support, maintenance, troubleshooting, and security monitoring of the Service.

4. Categories of Data and Data Subjects

Depending on customer use, processed data may include account details, contact information, team member details, operational records, comments, race-related notes, and other personal data entered by users. Data subjects may include customer personnel, team members, drivers, contractors, and other persons whose data is submitted to the Service by the customer.

5. Processor Obligations

  • Process personal data only on documented instructions from the customer, unless otherwise required by law.
  • Ensure persons authorized to process personal data are subject to confidentiality obligations.
  • Implement appropriate technical and organizational security measures.
  • Assist the customer, taking into account the nature of processing, with reasonable requests relating to data subject rights, security, breach notifications, and impact assessments.

6. Subprocessors

RaceWise.ai may engage subprocessors such as cloud hosting, infrastructure, monitoring, analytics, support, and communications providers. RaceWise.ai will require such subprocessors to protect personal data through written agreements imposing data protection obligations appropriate to the nature of the processing.
